Advantis student loan dispute

When I left university I needed proof for dwp about leaving dates.

The issue was I made an error because the form said date of last class attendance but the classes ended at Easter and after that was exams of which I had none so I put down a date a few days before the final loan/grant was issues though I was still on campus to end of June accesing computers and seeing psychologist.

This came back to bite me as now having a issue proving I stayed until June as no classes, and even if there was the lecturers dont take log of attendance and its been 5 years since leaving and all the staff in the department have changed (such as retired or moved to different university) so I have no proof of attendance and I am told since I signed a form saying I "left" in April that means I cant dispute it,

Sorry not sure if thats relevant to the actual disputed debt but I wondered how to get this sorted, the debt company is saying they can take wages but I only work part time (actually no better if not worse off than claiming benefits)

  • What are the consequences of not being able to prove that you stayed to June and how does the debt arise? What you are writing is not very clear.

    Sorry forgot I posted this, actual classes finished at Easter which meant end of March start of April so when I went on benefits after summer I put down classes end date April.

    It's all about interpretation they see it as classes ending in April (no exams on the course I was doing it was all assessment based) that meant I was overpaid as I left before the end of the year when I didn't.

    As it was a few years ago and I left on bad terms with the LL(he refused to give deposit back) and the faculty staff have all changed I can't get any proof of me leaving in June.

    So I am in a impossible situation.

    I still don't get it. If classes ended in April and you signed something to say so, where's the problem?

    If I understand the OP correctly - they are being chased for a benefit overpayment from the DWP (because of the confusion of when they left Uni). The DWP are threatening a Direct Earnings Attachment (DEA) and the OP would like to dispute the overpayment based on when they actually left Uni (I hope I have got that right).


    You may struggle to gather proof of this from so long ago - residence/ tenancy agreements may help. Otherwise it may be a case of trying to negotiate a repayment with the DWP to prevent them going direct to your salary. DEA are taken at a set percentage rate, that you will struggle to change once it is implemented.

    Its not the benefit people who are wanting money back its the SLC because they see it as me leaving at Easter therefore the loan paid in April is a "overpayment" since it was paid after I left.

    But I didnt leave then it was I didnt have anymore classes to attend

    Since the final payment covers from April to June they say I was not entitled to it as I did not attend.

    And the money they claim I owe is almost 4 thousand I think, not a small amount and when I am earning around the same as someone signing on its not as if I can pay £10 a week, more like a month.

    So your course ended in April, but you did not leave till June. Was the official end date April or June ? you claim they want four thousand pounds back from you, for just those three months ?

    You must of got some kind of certificate to prove you passed the course surly ?

  • Instead of going to your old department is there a central admin service you can speak to? I work in the funding office of a university and we'd be able to provide the official end date of your course just from looking at your student record.     I did try that and all they said is speak to the lecturers but they have all left since then, plus they say there was no attendance logs taken.

    I do also remember logging onto the network on campus after April but not sure if a few years later they keep logs.

    The issue seems to be not that they dont believe the course end date but the date I last attended as they are taking the date of last class to literally mean date I left.

    What the issue seems to be as well is I had to fill in a uni form which had written on it something like date of last attendace of classes which they see as date I withdrew.

    Combination of grants, and loans as I got the max amounts of each which came to about 9 grand a year,

    And no got no certificate as I left in the 1st year of a 3 year course due to personal issues and moved away.

    At most what I can do is I remember having to fill in a council tax exemption and they had my leaving student accomodation date as end of june.

    It sounds like you've filled in a withdrawal form at the university too, giving the earlier date. Whenever anyone at the university looks at your student record this is what they're seeing. No wonder they're reluctant to give a later date of attendance.

    If you left in June you will owe some money back, as your first year's student finance is supposed to last you until the start of the new term, usually September.
