Not giving enough notice

I've just looked at my current contract and they're asking for four weeks notice. What happens if I only give them one week? Will they not pay me my holiday entitlement or wages? I think four weeks is ridiculous. I've only been there for a few months, still on probation, I really don't want to wait that long to start a new job once I get it.

They could sue you for costs in replacing you (less the natural cost they would have incurred...though this is unlikely), they could provide legally a bad reference if you did not fulfill your contract.
They could not pay holiday or some work but you would legally be able to reclaim this back but they might feel a bit of tit for tat is fair play.Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -

I didn't mind it because I didn't intend to leave the company, I really liked the job in the beginning

You can ask them. Look at your written documentation to see whether taking holiday during notice period is expressly ruled out.

what notice do they have to give you if you fail probation?
If you get another job that may be a strategy if that notice is less.0 -
Depends it they are the 'alright' sort so really don't stress until it happens. Same goes for those that know they have a queue for the job, so d always recommend you either have someone to suggest for the job or plant the seed that they should start looking as soon as you hand in notice - a bit like early tenant surrender, it's what I'd do in future along with reminding them if they have ever inconvenienced you.
I've only ever worked for one completely angry company out of hundreds.
They did calm down, although to late to repair relations, as soon as they realised they could get someone to start work immediately their thoughts soon changed. I would have been out of the door a lot quicker then originally argued over.0 -
checked my contract, apparently I must take accrued holidays during my notice, woohoo!
and it also says that while I am on probation, the company can terminate my contract with one weeks notice but I have to give them one months notice. I don't get it, how unfair.0 -
You signed the contract. If you didn't bother reading it, or didn't feel any of the clauses were unfair at the time, you can't really complain now.
The reality though, is that most companies would expect to have to wait a month or more for a new employee to start, to cover the notice period.0 -
My colleague said that by law no one has to give full notice while on probation...I'm confused...
To be honest, I work in a customer service, they wouldn't have any losses if I left early...0 -
Personally if I were you I would warn any new employer that it is possible that if you don't like the job after a few months you may leave with short notice as at least they can be prepared when you get fed up or don't like it anymore.0
