Nearing discharge pay rise due

First of all I'd like to say a big thank you to everyone who posts on here. I went BR in November last year and I can't believe how quickly it has gone. I haven't had an IPA as I had a deficit of income to expenditure.

I am likely to get a pay rise in November which will be backdated to September by way of a small lump sum in November. The November pay day will be after my AD and I am likely to get the pay rise confirmed around my AD date. I'm not sure if confirmation will be just before or just after as there isn't a set date for confirmation.

After searching the board I can't find a definitive answer to my question which is do I say nothing as I won't have a change of income until after AD or do I have to notify the OR if I find out a few days before AD even though it won't take effect until after AD ?

Thanks in advance

I won't get it until after AD even if it is backdated.

Are you suggesting I contact the OR after I have been discharged to say I've got a payrise after discharge ?

I know the bit you have highlighted but I don't believe it is that straight forward. I actually think the payrise won't outweigh the deficit anyway so could well be an academic question and I would still have nothing to pay up. however I am interested to see if there is a definitive answer to the question.
  • Hi,

Closest thing I can find is the wording contained within an IPA agreement which is that you will notify the OR within 21 days of you becoming aware of the change of income.
As I see it, at the moment, you are speculating on as to whether you will receive an increase.
I would see it that once the pay rise has been confirmed to you, then you would have 21 days to inform the OR.
Back date or not, until it's confirmed I do not see that the 21 day clock would start ticking.

  • Thanks debt doctor that helps a lot.

So if I understand correctly, if I don't get confirmation until after AD then I don't need to notify the OR.

What happens if I get confirmation say a day before AD ? I would have 21 days to notify but. One day in and I would have been discharged. Not really sure what happens in that event.

I said likely because I have not had confirmation that I will receive one because performance management isn't completed until the end of October then it goes to the board then you find out if you have got a pay rise sometime in November. No exact date known. However if I receive one it will be in my November wage at the end of the month which is after my AD.

How am I avoiding paying what's due ? (Text removed by MSE Forum Team) The payrise should not outweigh my deficit anyway so I very much doubt I would have any to pay even if it wasn't after AD. That's why I said it was academic. But I would like to find a definitive answer. What I want to ensure is I abide by the rules but at the same time like any sane person not paying more than I have to.
  • This is a forum that gives advice and support to bankrupts.
All I see is someone asking for clarification of the rules around notification and abiding by those rules.

  • My own experience of dealing with my OR and my IPA, has been that I inform them when I have confirmation of what is happening with my income (when I mentioned my pay may increase, the OR said to come back only when its confirmed).

They can't try and set an IPA based on figures that aren't confirmed, so if you aren't notified of what the change is going to be before discharge then you don't need to inform them (everyone can speculate they are due a pay rise at some point, but until confirmed by your employer it's not guaranteed to actually happen).
