e Cash Window (EPDL)

Afternoon, hoping someone can help with this one...

Received a text message today 'COUNTY COURT JUDGEMENT being issued to your address today'

Apparently I had a payday loan with EPDL (now e cash window) back in 2011, they say my final payment was in May 2012. They are contacting me today, first contact since 2012 saying I still owe £42.50

a) where do I stand in terms of still owing this money. As far as I'm aware my final payment in May 2012 paid the balance off.
b) will they really produce a CCJ for £42.50?

After speaking to them today they say they emailed me Sept 2012 with the balance owing. No other contact phone/text etc. Until today

Thanks

  • Ask them for a full breakdown of the debt - do you have any copy correspondence confirming settlement?

What does your credit file show?
    :hello:
  • Hey, yeah going to request a CCA.

There is nothing on my credit file. Been monitoring that for a while now due to mortgage app etc.
  • So the loan isn't recorded across any of the credit reference agencies? Lenders may only report to one of the many agencies so you'll need to check all of them.

Go back through your bank statements to get the dates of payments.

Are you sure that there weren't any late payment fees etc? These can really stack up in monetary terms.

You need to be sure that you did pay everything.
    :hello:
  • Yep first thing I did was check bank statements. I can see payments being made in 2012 and then May is the final payment.

I'm just going to have to wait to receive CCA and see what's going on. Currently only with one credit reference agency and it ain't on there.

    Hi antpresto

I am a little sceptical about the text message you've been sent - county court small claims correspondence is sent by regular post, not served in person, so the text's sender couldn't possibly know the precise date on which you would receive this or that paperwork. I expect the text is just designed to get a response out of you.

Plus, if you've not heard from them at all before now, it's highly unlikely they would have complied with the pre-action protocol for court claims.

Keep us posted when you get the info back from them.

  • Thanks, my thoughts exactly.

I thought I'd start a thread just in case anyone else was suddenly receiving calls, texts, emails etc from the same company.

  • CCJ for £42 - it will cost them more than the debt to register it.
  • I got this text message from them earlier today;

"COUNTY COURT JUDGEMENT at your home address being issued for OVERDUE debt to Ecashwindow /Early Pay Day Loans. Call 01908 440050 to avoid ref xxxxx"

I do have an outstanding loan with them but have a payment agreement plan in place and have never missed a payment on that, the last one being a week ago. They shouldn't be allowed to send threatening messages out like this, particularly when I have an agreed plan in place.
