CCA/Prove It/Old Debt

Hello
I’ve been a long time lurker on these forums having used this a number of times to help with previous debts and now I am looking for some help/advice to ensure I am on the right track.
I took out a Barclaycard in around 2002-2004, the interest became crippling over the years and in 2007/2008 from the advice on these forums I went down the CCA having stopped at the time paying it.
Barclaycard never provided the CCA request. I believe the last time I acknowledged the debt was in late 2008/early 2009. In all honesty with a lot else going on in my life, I forgot about it (I know this isn't normal) But for me it was out of site out of mind.
Cut to now, I have never made a payment or up until I moved have received any communication and over the past 4 weeks I have received 4 letters from Lowell finance who the debt has now been sold to and what was about 4000 is now 5500.
I plan on sending the ‘Prove it’ letter to them as unfortunately I have nothing of the original correspondence from the original time I contested the CCA.
Is this the right thing to do?
The last letter from them this week was the most threatening saying they plan on taking me to court, have carried out a credit check on me and believe I am working and have other creditors.
All my other debts will have been paid off in a year. Would you recommend paying everything back? Offering a small amount each month?
I don’t know what to do with this one.

    Hi,
If your dates are correct, the account would of become statute barred late last year/earlier this year.
I would not send a provit, or CCA letter, I would write and inform them the debt is statute barred, and ask them to prove otherwise.

Also state you would defend any claim made against you, on the same basis.

  • Thank you so much for your reply.

My problem is I was dealing with a lot at the time and while I'm pretty sure they are the dates I could be wrong as between 2007-2011 my life went into a tailspin.

Would you still advise sending the letter advising the debt is statue barred?

    Thanks in advance.
