Employer not paying new schedule

My ex H was reassessed in June as having to pay £80 / month more than he does at the moment. There are also arears on the case and there is a DEO on the existing claim. The CSA sent me a schedule which said that the first new payment was to be taken from August's pay check plus the arrears and they told me on the phone that I would therefore be receiving the first payment in September.

Unfortunately, the employer is still sending me the old amount. The staff at the CSA don't seem to feel that it is a priority to sort this out and they said that they can't make the employer pay the scheduled money -(really?!!) but that they will have to get in contact with payroll which could take some time.

Is there anything we can do about this as we really need this money.

    From other threads, I understand payments for the month are after the 19th of the said month, so the September amount wouldn't be seen until October. (unless you get it weekly).
  • Hmmm Employers have until the 19th of the following month to send a payment to the CSA so something going out in August should have reached CSA by 19th Sept. The CSA then say anything upto 3 weeks for payment to get to you.

    Have you actually received anything yet?
  • Yes I've received the amount from the old schedule. When I phoned the CSA they said I should have received the new amount by now...
  • Does he earn enough to cover it? The employer has to leave a certain amount for your ex to live on so even with a DEO in place you may not get the full amount. Whatever can't be deducted one month rolls over so if his salary increased or there was overtime you may get fluctuating amounts.

    You would think that CSA staff would have made sure the earnings were sufficient to cover the schedule but they have been known to make the odd mistake!

    The DEO has to arrive at the employer before the salary cut off date. This may be the problem there. Usually they're hot on threatening employers with criminal compliance measures if they fail to make required deductions
