Do I have any claim agaist HP company?

I bought a car two months ago from Arnold Clark. I was downsizing to try and help my financial position. Last week it developed a problem with the automatic gearbox, so I drove it 30miles to get checked by what I thought was my nearest Citroen dealer. Today, they phoned and asked if they could change the oil at a cost of c£60 + the original £65 for the diagnostic check. I said alright if they thought it would work. Anyway they have now phoned up and told me that it needs a new gearbox, at a cost of c£3000-£4000. I'm trying to speak to the manager of the garage where I bought the car, but he's not available until tomorrow. But surely such a major breakdown might be covered under the goods not fit for purpose under the hire purchase agreement. Any advice would be gratefully accepted. I can't live without my car, but I can't afford to get it fixed.

    I'm sure you would have a claim under the 'not fit for purpose' have you spoken to trading standards, also if you don't get anywhere with them you can speak to the national concilliation service, this is a long process but they sort out the problem between you and the car dealer through letter.

    Have you spoken with CAB or looked on their website.

    First step must be to talk to the gargage where you bought it.
    Was there a guarantee with the car... although even if not, the sale of goods act would almost certainly cover this situation.
  • Thanks Clapton I did phone and spoke to the salesman, he has told me to phone tomorrow morning when his manager is in.
    Carlih thanks, I've just been on the consumer direct website and I have printed off a copy of goods act, so I'll take that with me when I go to the garage tomorrow. It has occurred to me to telephone the HP company tomorrow as well.

  • Thanks for all your support you guys. A huge success, I hope. Tuesday was a terrible day, what with the lawyer saying that I would have difficulty getting my money back from MVI, and the bad news about the car. The good news came today, the car has been put right, and "as a measure of courtesy" Arnold Clark have repaired it free. I did quote my consumer rights to the manager in ACs, but he was keen to tell me it didn't apply to my purchase. Yeah right!!! Whatever! I'm getting my car back tomorrow, free of charge. I feel like I've won a battle:j. Now I must focus on MBNA for the MVI deal:think:.
