I CCA'd Cabot for an old debt which has done the rounds of umpteen debt collectors. They have now responded saying that they cant provide me with the information within the relevant time period. They say they will continue to request the information and that my account will be put on hold with the Customer Care department until they can comply with my request.
They then go on to say that it is currently unenforceable which means they can't take me to court but I am still obliged to repay the outstanding balance and they want me to set up a repayment plan.
So .............my account is on hold? but they still want me to pay? Can I wait on this until they do provide the paperwork or wait and see if they eventually come up with a greatly reduced settlement figure?

Hi swampy
A creditor can still request repayment despite acknowledging that their debt is (currently) unenforceable. Of course, it means that they are totally reliant on your willingness to agree to this.
How old is the debt, and is it still showing on your credit report?
This all increases the likelihood of them offering you a substantially discounted settlement figure, as they may be looking to cut their losses.

This debt dropped off my credit file last year and I'm not inclined to be generous right at this moment. I think I'll sit tight and see what they plan to do next.
Thank you

Off your credit file already and acknowledged as unenforceable?
I would agree in that case that you're right to sit tight. The debt is pretty much a white elephant as it stands.
