JSA claim?

Hi

My partner currently works nearly an hours drive away from home, he does not drive and relys on his brother for transport there and back. However his brother has now got a new job and can no longer take my partner to and from work and transport is not available to get him to work on time. Also his employers cannot adapt his working hours to suit this so he is looking at handing his notice in.
I would like to know if he's does will he be able to claim JSA straight away? Will they delay his payments? Or is his reasoning good enough?

Thank you

  • what do you mean by transport is not available to get him to work on time

they will expect him to travel up to 90 mins each way on public transport so if it is less than that then he will probably be sanctioned

is there no way for him to get a moped or something small that he can use for a backwards and forwards to work?

Can he work around the transport problem, if there is no one else nearby can he cycle/ get a bus part way?
  • He has to start at 6am and other weeks does not finish until 10pm. We can not afford a moped so that's a no and I don't think cycling to work is a practical solution as it would take 2hours! There are no buses or trains that leave that early or come back that late either. So his only option is to leave in my opinion

Opinion about the bike fare enough, The reality about riding a bike is that this is doable and should he walk out of employment then he gets nothing which is more than fair.

Because of the hours it might be a good enough reason not to be sanctioned.

Presumably your partner knew about his brother's new job. What did he do about trying to find another?

They will want proof that there is no transport available/no other means to get to work, (bus/train timetable etc proof that he has asked his employer for a change of hrs - get a letter done and a reply) - and most importantly proof that he has applied for other jobs.

Having said that some kind soul may allow the JSA claim.

More importantly is the fact that JSA pays very little so his search for a new job should be taking priority - any job/two part time jobs/weekend work. Relying on benefits is foolhardy.

You can read about sanctions and good reason for leaving work here:

    34493 is probably most relevant
