a company has not provided what was requested under a SAR within the 40 days. Is it just a complaint made to the ICO that would happen next?

The ICO is your next port of call however they are pretty useless so I would not hold much hope for anything to be done here and if it is they will certainly not rush for you.

It depends what you mean by "not provided what was requested" - have they simply ignored you, or not given you what you want?

If it's the latter, be aware that there are exemptions, meeting the request could involve disproportionate effort, or it could be a repeated or unreasonable request.

However, if you believe an organisation has failed to comply with the Act, rather than simply not giving you the answer you want to hear, complain via the ICO

If they are being totally unreasonable you could go down the legal route.

You'll need to submit a "Part 8" claim for with a specific performance order for them to comply. This costs £280 but if you have this awarded in your favour you can claim your costs back.

A court claim will certainly get them moving.

Yes the ICO. I found them pretty good actually.
