Money lending

hi,
Not sure if this is the right place but hoping someone can help me.

My brother asked to borrow £4k to purchase a new sofa with him and his girlfriend. I gave hime the money by trasnferring to his bank account.

He promised to repay once his girlfriend's divorce went through as she was getting some money. Since then they have split, and now his girlfriend is refusing to pay.
Is there anything i can do to get the money back?

  • If you have evidence of a loan agreement, you could go via the small claims court.

    not unless you have signed paperwork to say it was a loan and they were both liable

  • well the fact i transferred money to them shows it was paid. they then purchased a sofa, with that money. is there not anything on the count of that?

    Your brother asked you to lend him the money; your brother promised to repay you when his girlfriend's divorce was settled; you transferred the money to your brother's bank account.

    As zx81 mentions, he might claim it was a gift.

    Whatever happens, I think it would be difficult to force his ex-girlfriend to repay the loan . She appears to have had no part in forming the agreement.
  • Cant see why people who are skint would want a £4000.00 sofa anyway as you can get them a lot cheaper than this, I suspect they knew they would not pay you back and probably got one for a £1000.00 whilst spending the rest on something else.

    You have a potential claim against your brother, even without any written loan agreement ... whether you wish to pursue him through the courts for it is another matter.

    Does he acknowledge the debt ? What is he proposing about paying you back ?

    But spending £4k on a sofa .... when he knew he had to borrow the money to pay ? seriously ??????
  • As you are all assuming my brother was in money problems and assuming his lifestyle is wrong, can i please correct you all in sticking to the facts and not your opinions.

    The loan was to both of them on the basis that when her divorce settlement come through she would repay it. I offered to lend the money interest free on this basis.

    Not they have split up, i would still like my money back and the money was for them Both, not just one
