Job Offer Rescinded

Hello

I hope someone can help me with regards to my rights in my job or offer some moral support as I have had a rough few days.

I currently work full time for a charity and have been for the past year and 2 months. I had 2 job interviews for a different charity and was offered a new job. I took the position, handed my notice in to my current employer and received the contract to sign in the post. However, I took a call yesterday to say my job offer was rescinded as one of my referees couldn't confirm a certain area of my job experience.

In distress, I called my current employer and very luckily, they have decided to take me back and retract my notice period. However, upon arrival to the office today, I was told that because I handed my notice in, my current employer had started a process to restructure my role and because of that, I will now be subject to those changes (once they are confirmed by our HR consultants). These changes include a reduction in my responsibility and a salary decrease of around £3K.

I can understand why my current employer decided to restructure my existing role if they thought they were being given the opportunity to re-advertise it and employ someone new. With regards to the charity itself, I can also see the business sense in doing so.

What I would like to ask is if anybody knows my rights with this situation i.e. do I have to accept the restructuring of my role regardless because I did hand my notice in or can I ensure that my role stays the same (including salary) in any way?

  • Thank you. I did speak to ACAS but found it hard to explain the complexity of the situation over the phone.
  • tbh I would consider myself very lucky,even with a £3K reduction, to have been allowed to stay following handing in of my resignation.

    I think you're going to have to suck this one up as the only alternative in reality is the dole queue

    I would suggest that your options are limited. You can either accept the new job being offered by your old employer or continue to work your notice. Your old job has gone.

    Have you discussed this with the referee? Sounds strange.

    Could the charity be using this as an excuse to pull the offer for other reasons?

  • Just a little piece of advice for the future (though I'm sure having been burnt over this experience you don't need telling this) don't hand in your resignation until you have it confirmed that everything is ok with the new position
  • Not gonna lie, i wouldnt be pleased with that referee to say the least.

    Stick at it BeckyLou, write things down, dates, what people have said, then when you have a clear mind , phone ACAS again.

    Remember that you only have 14 months service with your old employer. They can, should they wish, get rid of you for any non-discriminatory reason they like at any time they like until you have been there for 2 years.

    Employers can also organise/re-arrange/restructure as and when they feel the business needs dictate and there is very little even an employee who's been there over 2 years can do.

    They had no obligation to agree to you withdrawing your notice nor to change their restructuring plans. You have shown that you are planning on leaving them and probably will continue to look for another role elsewhere in the near future so why should they change their plans / possible savings for your disloyalty - I know that is a tad harsh but you get what I mean.

    Basically consider yourself at this particular point in time very lucky. Yes losing about £170 a month in pay is tough but it has got to be far better than being without a job and trying to live on £73 a week.
  • Did you get a chance to explain why the referee could not confirm a certain area of experience? Sometimes they just give little more than start and end dates.
