From my understanding you can terminate the contract for someone who is long term sick on capability grounds. I would suggest though your employer seek profeseional legal help with doing so, as if they put a foot wrong they are inviting a claim for unfair dismissal.
Most employers should have this written into their employment manuals or maybe the contracts.
The procedure can be quite long winded, but if an employee is obviously taking advantage, then the procedure should start ASAP. Don't be surprised if the employee enlists the help of ACAS/Unions/employment lawyers though.0 -
I wonder this too.
One man my husband and I know, has been off sick for 11 of the last 15 months, just because he had a small lower leg operation.
He is in his mid 50s, and is the laziest person we know. He is DESPERATE for them to make him redundant, but they won't; especially as they would have to give him about a 60 thousand pay off!
We simply cannot fathom how he has managed to have SO much time off! He is such a faker too; he claims to be in so much pain (to his boss,) but we see him playing footy with his mates on the field.Proud to have lost over 3 stone (45 pounds,) in the past year! :j Now a size 14!
