Parked car opened their door in to my moving car as I drove past. Who's at fault?

It is the imaginary child that is lucky, not op. It is lucky that the imaginary child didn't run in to a moving object.
I'd love to live in your world where being side swiped can always be avoided and all accidents seem to be preventable. Because sadly in the real world there is always a point of no return for accidents and most of the time for one party was unpreventable.0 -

Possible specifics a blue light vehicle which you should be aware of and let them pass when safe
Being aware that there is a vehicle behind you is fair enough, but I agree with the point made by warehouse.
Why does it matter if you don't know whether it's a Ford Focus or a BMW 525 as long as you know if it's a car, motorbike, ambulance, lorry etc?0 -
My point is awareness not necessarily knowing the exact vehicle, many people adhere to the rule of what is in front and forget awareness of what is going on around them and Londontiger states this very thing in his post.0

Presumably to check you are aware of your surroundings. When I was taught to drive (not IAM) I was told it was best practice to check your mirrors every 10 seconds. You are also meant to check your mirrors before making any changes to your speed such as braking or turning right just in case some idiot decides to overtake you. You may think well !!!!'em they can crash in to me if they want but you have a duty mitigate accidents as much as the other driver.Drivers get fined when passengers dont wear seatbelts,0

There are many aspects to this that could be questioned.
You say you came round a corner, what sort of corner? Were they (illegally) parking 'too close to a corner' as defined in the highway code?
Were you paying attention when you turned that corner, was it a junction, were you looking right/pulling out and didn't even think about parked car danger.
The starting point, I feel, is that it's their fault as they've not checked it's OK to open their door.... but, upon inspection, other factors could be questioned, making it a tougher 'fight'.0 -
As I was driving along slowly as I had just come around a corner, a passenger in a parked car opened their door in to my car door. The only damage is to the door.
To me, this cannot be my fault? At the time the driver said she would prefer not to go through the insurance companies. I got a quote and the other driver has asked me to pay half. I've said no.
She has said it will have to go through insurance company then.
Her argument is that it was my car that was moving and her's was stationary! How does that make her in the right? She's admitted in a text to us that the passenger opened the car door in to me.
Am I missing something?

Simple. The other car owner is a scamming retard. Either claim on your own insurance and get them to claim off her or get it repaired yourself and issue her with an invoice/LBA/Summons.The man without a signature.0
