Claiming Mortgage arrears and fees

Any advice would be appreciated. I had a mortgage with Northern Rock and during 2007, I was unemployed and got into serious arrears with the mortgage. I got charges for arrears, a court appearance and also a guy coming to the house to give me advice on making the payments!! I know its been 8-9 years and I sold the house in 2010 after paying all my arrears, and also its Virgin now, but where do I stand on claiming the charges etc back. Also there would of been an exit fee too. I was going to leave it, but Northern Rock were very quick to try and take the house, even when I was desperate. I feel that anything would be a good revenge on them. Any help?

    That all works against you as the FSA ruling on these fees was that they are acceptable as long as the work that they are paying for is carried out.

    Northern Rock do not exist any more. The company failed. There is no legal entity for you to get revenge against.

    You are allowed to make your complaint but it would be the taxpayer that picks up any bill as you would make it to NRAM. However, you need to clearer on your reason for complaint as there doesnt appear to be any wrongdoing in your case and Northern Rock were not one of the companies that the FSA had an issue with when it came to arrears charges.

  • Thanks for the reply. As Virgin have taken Northern Rock over, I could still seek to claim something back from them could I not? Basically, I had no income and kept telling Northern Rock that I will soon be working and please give me some leeway. They didn't and instead, took me to court to reclaim the house and also sent a guy to the house to discuss with me how I was going to pay my arrears off. I told him what I told Northern Rock, yet I got a big bill for the court and also a fee added to my account for the guy coming, which I never asked for. I had fees galore added to my account and when I came to settle my account, it was A LOT more than the original balance was meant to be. I feel I was ripped off in a big way and very unfair at the time. Also I had to pay them an exit fee when I paid the mortgage off which stuck in my throat even more!!

    No. They are not liable. NRAM is liable.

    its a horrible situation to be in but the bottom line is that what they did is what can happen if you dont pay your mortgage and costs are high if it happens and you pay them. Someone has to pay for it and that someone is you. Bank solicitors are not cheap.

    When did the FCA say these arrears fee's were acceptable ? What ruling ? !

  • Thanks for that Dunstonh, but it doesn't help me at all. I know someone has to pay, but I am also aware that it is unfair and unjust and I was in severe hardship at the time. Ive read your link brown1950, and I am going to write to NRAM with my account number at the time and ask for all my charges to be listed. I'll then follow the guides and see how I go. I have nothing to lose other than 10 pounds! Thank you both for your time replying.
  • You can put in the complaint without a full list of charges actually made.

    That does not mean it will be upheld, but you are entitled to complain.
