Vodafone and Lowell Portfolio

Hello I am not sure if this is in the correct place, can the mod please move it if not. I have tried reading the some of the vodafone and lowell problems people have already had.

I recently returned from holiday and got a letter from Lowell Portfolio saying I owed them £50.51. I investigated this and found it was for a dongle which I used 4 years ago. I was still paying for the dongle up until September 2014 when I rang up to cancel. The lady I spoke to said everything was fine and I could cancel my direct debit. Which I did. Now it's a year later and I get this letter through my post. I did move house so maybe vodafone tried to send mail to my old address but I definitely received no email for this past year saying I owe this money.

I tried going in to the vodafone shop today and they couldn't help me. I tried ringing vodafone and got a Indian lady who couldn't understand my name so she was no help and kept telling me to go to my nearest store with proof of ID and finally after asking for the manager for 3 or 4 times he comes along and turns out to be one of the rudest people I've spoke to on a telephone and kept shouting the word logical at me.

Is there anything I can do or am I going to get screwed over by vodafone's useless support and have to pay this amount and have a mark on my credit rating ?

Cheers for any help you can give,
Scott

    Hi,
Never attempt to settle matters like this on the phone, it rarely gets a positive result.
Send a "provit" letter to Lowell's, this basically asks them to prove you owe the debt they are asking you to pay.

They should come back to you with more information.

Provit letter available from the stickies at the top of the forum.

  • Do you know if Lowell have bought the debt (i suspect they have) and if so can they prove there was a contract with Vodafone that permitted them.chasing you and likely registering a default.

I only ask as I sued Vodafone in 2013 for an identical situation whereby there was no contract and they wrote confirming such but saying they sell these unsubstantiated debts on.

I'm in the process of suing Lowell for chasing a debt they knew didn't exist so might have so.documents that can assist you given the.near identical situation :)
  • Hi guys, thanks for the replies!

They said they bought the debt yes, the number they quoted as the account number is the number I got for my dongle account when I went back and checked my emails from 2011. It was a rolling month contract if that makes any difference? So I did have a contract with them I think?

Its worth doing a SAR to Vodafone to ask for the contract as during 2008-2012 they admit they never sent out T&C for this period relating to charging and correct cancellations so thats a pretty solid defence as to why the contract can't be seen as enforceable even moreso if they.didn't have a signed copy to start with.

PM your.email address and when I'm back home I can compose an email and some documents that.may be of help that at the very least should disprove any lies they are likely to tell you (Ive used my court judgement to help several people.get Vodafone debts wiped)

Yup, got it replied and sent an email with some documents that I am happy for you to use if Vodafone try their usual stance of lying to extort money.

  • Hi guys,

Just like to say, Lee has been in contact with me twice over the last few days and he has managed to sort the whole problem out, they are going to have to buy the debt back off Lowell and then get it removed from my credit report, really happy with Lee's communication and helpfulness.

Thanks for taking the time to email me as well skyshadow, I did read the email and did appreciate it but thankfully/hopefully everything will get sorted over the next 6 weeks on Vodafone's end.

    Cheers,
    Scott
