copy of property deed.

Not sure if this is the right place for my query but will give it a try and hope someone will direct, if necessary, to the right section.

I am having a bit of an issue about repairing a boundary fence with next door.

How and where can I see a copy of my deed to ascertain weather am responsible for the boundary fence??

My mortgage is with the Halifax, would they send me a copy of this clause covering this issue? also would it be free or chargeable?

    mirand - the registered details are rarely the end of the matter re such issues. Most registered titles do not state who is responsible for which boundary and where they do it may refer to an arrangement from many years ago and which is now no longer binding.

    If the houses were built by the same developer and you are both the original first time owners, and the titles refer to covenants relating to boundaries then that will be a big help. If not then it usually comes back to discussing and agreeing.

    My advice is to check what is registered for each property, check what particulars of sale you were each given by the previous owners, read our guidance on boundaries and then agree a way forward.

    It is very rare to be able to ascertain whether you or your neighbour are responsible. It is often more of a case of you both agreeing who is.

    This should have been confirmed by your solicitor prior to completion. Do you still have copies of the paperwork?
