CCJ Error (I think)

I have a few questions that I thought I should finally ask.

I was made bankrupt on 3/11/2010 and I'm fully aware that this will remain on my file for up to 6 years the problem I have is that I also have a CCJ on there dating 14/2/2011 now the CCJ involves a debt that was included in my bankruptcy I wrote a letter when I received the CCJ that year (I think I still have it) but since I have wrote a more recent one and had no response.

So the question is who or how do I get this CCJ removed?

My next question is that a lot of my defaulted debts are still showing as active that something that happened? I've never checked my credit rating before because I never had the need to.

Last question I've managed to get a credit credit card from capital one. Is there any other at I can help with my credit rating. I realise that they're not relevant to creditors as they go off history but thought I'd ask.

    So the question is who or how do I get this CCJ removed? You could apply to get the CCJ set aside at court with the defense that it was included in the bankruptcy although I'm not sure how much this costs as the fees have increased recently.
    Otherwise it will fall off your file 3 months after the bankruptcy in any case.

Look at the clean up sticky on the top of this forum and use the templates to send to creditors to make sure the dates and statuses are correct.

    Thanks for the response. So my CCJ would that do that with it being 4 years ago? I shouldn't have to pay surely if it's their error?

  • The CCJ should never be chased as it was included in the bankruptcy, but will remain on your credit file for 6 years from the date it was granted.

    If you wanted to remove it earlier you can apply to the court for it to be set aside for a fee but there probably isn't any real benefit to you in doing that as the bankruptcy is a bigger black mark than any CCJ will be (it might be different if the CCJ was applied for a long time after the bankruptcy).

    The CCJ was granted a year later. Would that mean it's their error?
