CCA clarification

Hi ,

Just wanted some clarification if possible on a CCA request i have gotten back from Lowell.Debt relates to HBOS who have taken about 6 weeks to produce a credit agreement.

Lowell said until it was found they'd close the account.The credit agreement sent is proper and not reconstituted and i have signed it and dated it.However their signature boxes are completely empty and there's no stamp or any mark applied by them on it.

The agreement is from Feb 2006 , so does no signature or mark of any kind from them deem it unenforceable, as i believe it to be so but want to check before i respond to Lowell.

    You could use that argument with them, but challenging credit agreements on technicalities such as this, can be notoriously difficult.
    Ultimately only a court can decide one way or another.

    You can roll the dice, and see what happens, they may back off, they may not, all I can suggest is try it and see what happens.

    Thanks , i know technicalities aren't fun to deal with but from what i've read for pre 2007 it seems i'd have a reasonable argument that they haven't signed it.

    So as you say could be worth trying that route and seeing what happens,
