If/When I go back to work am I still entitled to holiday leave?

I'm still unwell and still off but I was wondering that when or IF I ever get better and go back to work that I am still entitled to my 3 weeks holiday?

Also what happens if i don't go back yet and am kept on what happens to my holidays that I've not used up? It restarts every Jan.

Sounds cheeky I know but surly I still have a right to it? Don't I?

    Yes, where a worker has not had the opportunity to take the full entitlement to annual leave because they have been absent due to sickness, any remaining entitlement can be carried forward to the next or subsequent leave years.

    There is a special exception allowing carry over in the case of long term sickness absence. However, I think it is unlikely that you would need to worry about carry over. I am afraid that the chances of someone who started work in January and has now been off sick for approaching three months still being in employment next January are fairly low. In which case you would be paid for any outstanding holiday.
