  • as I understand it, you have become bankrupt and not your wife.

    The interest in the car is 6500 -1000 = 5500

    If your wife is able to take a loan or offer the OR payments for this car for this value then effectively what she contributes towards the collective family budget monthly income is reduced.

    You should be able to show this as a necessary cost in her outgoings e.g. £200 a month to repay car loan which means she'll bring £200 less to the family pot. Which means you will have less available monthly income from which tthe OR will calculate a payment to be made as part of your restrictions.
    Whether she is able to finance this from existing income, a loan from wider family or otherwise should be looked at by you both

    Hello all
    As an update for you all, having put all the relevant arguments to the OR, he has still decided to take the car and is not letting me have an allowance to get another. He says we have had since March to save for another for which my reply was we have not got the money to save since there is no disposable income. My wife is not able to raise the money to offer to buy the vehicle so there is no option there. The car is being collected on Wednesday of next week so getting to and from work will be awkward. Since my wife is on a much better wage than myself I have had to go to my employer and say I can no longer work late and this has not gone down very well at all since the pub trade is a late trade. At this point I can only manage about 350 for another car so we are going to look good and hard for one at this sort of budget. They are there at this price but really need something reliable. Only plus side is I will be working less hours which means less income which means less payment to the OR each month.

    Thanks for the update - what this does reaffirm I guess, is that planning for BR (when that is possible) is critical and that in your case, the OR is making the point too.
    I am sure you will find something - there are old cars around and I know some luck is involved finding one, but it is possible. My 'banger' has passed its MOT 4 years on the run and with the exception of tyres and an exhaust repair, has cost me nothing and served me reliably for all that time.:)
