Offered a job, but want to keep looking

I currently have a job paying salary Xk and a 3 month notice period.

I have had several interviews lately, and Firm A have offered me a position with salary X+6k.

I would like to accept this position. However I have a 2nd round interview (and there is only 1 other candidate) for Firm B that are advertised at salary X+6k to X+16k.

Firm A are aware that I have another interview with Firm B next week and are keen that I sack this off if I sign their contract.

The recruiter for Firm A has said that Firm A will want me to sign something that means I can't go to any more interviews.

Is this possible? I don't think so, but want to check

  • All I have to say is a bird in the hand may be worth two in the bush.

Push Firm A too far and they may withdraw the offer
  • Agree with initial response, however you say

Bear in mind 'The recruiter', if this is an agency they stand to lose probably up to 20% of your salary as commission for your placement. It could be they who are trying to protect THEIR interests.

Have you had a job offer in writing from firm A, if not, carry on going to interviews until you do.

Just gone through something similar, accepted job offer A, but could have pushed a job offer B.

Reason I accepted, they were quick, knew I was in for another role and didn't mess about, they committed to me so I committed to them.

Oh I get that the recruiter has a vested interest of course

But the main reason I started this thread was to answer the below questions:

Can a company make you sign something to say you won't search for other jobs in the notice period before you start work with them?

The only thing I would say is lets say you did sign something and then you still went for the interview. Then there would be two outcomes:

1 - you get job B. In the case of Firm A, you will probably be on a weeks notice during probation, in which case you could start there, hand in notice on day 1 and leave after a week before starting job B. Most likely, Firm A would say not to bother starting.

2 - you don't get job B. Hopefully Firm A won't find out and no one is the wiser. If they did find out, then they could sack you in your probation. I can't see them doing it, but in the first 2 years of employment they can sack you for no reason.

If you don't sign it, there is a risk that you lose the offer from Firm A and don't get job B - clearly what you want to avoid.

They can't make you sign anything, but equally they can't enforce an unreasonable term - so you're free to sign it in the knowledge no harm will come to you if you do attend the other interview. I'm not sure how they think they would enforce it anyway, in the worse case they'd take you to small claims, at which point the judge would tell them to take a running jump.

Summary - it's hot air. They have no right to restrict you from seeking alternative work ;)

But as you will have less than two years employment with them, they can pretty much fire you for any nondiscriminatory reason.

Of course, but they can do that whether he signs it or not. The point is this agreement not to seek work has no legal standing.
