Cabot debt

Hi, I am hoping someone can give me a bit of advice. Last year my partner received several letters from Cabot threatening debt collection or court proceedings if she didn't pay back an amount of money that was owed. The only debt my partner could remember was one about 11 years ago, so we sent them a Statutes Barred letter and we heard no more. Last month my partner got a letter from a solicitors called Mortimer Clarke threatening to take her to court if she did not pay the debt, so again she sent them a Statute Barred letter. This time though the solicitor sent a letter back confirming that they had received our letter and telling us that the debt was to Cabot finance and the last time it was paid was 29/11/11 which is completely false as she has never made a payment to them. I would like to send them another letter asking them for proof of debt but am unsure of what to put or if this is even the right way to proceed?

    Dear Crapbot. I deny that any alleged payment you claim was made and reiterate that this debt is statute barred. Should you commence court proceedings I will defend in full and bring the matter of your false claims of a payment to the attention of the court.

  • Hi Im new and need a little help... Had a flexi loan with HSBC which I had problems paying, No PPI but currently going through Financial Ombudsman re unfair charges. In mean time Cabot have taken over debt - Mortimer Clarke. Court action.... sent forms to Court and nothing has been done yet. Mortimer Clarke have had several letters off me sent recorded with expenditure etc. last letter recorded with a £1 in it as a token payment until my circumstances change(mental health issues and no accessible income at present). Today received a letter again about sending income and expenditure form! What should I do as they are not being helpful really and I am struggling to keep sane about this, they have received letters form me as they have been signed for. Do I go back to the court and find out if judgement has been made. I originally paid £1 per month to another debt agency but they went bankcrupt! Hence my situation now

    Needs a new thread really.

    If the court had issued a ccj, they would have written to you.

    You can of course phone them and ask what's happening, quoting the claim reference. It would also be on your credit report.

    How much is this debt, and how much do you think the ppi reclaim will be?
  • Hi thanks for the reply.... There was no PPI on the loan as I didnt have a job when I took out the loan. The court havent given a ccj yet so I cant understand why the debt collecting agency being so difficult....Its not that I dont want to pay I am at the moment only able to offer token payments. The flexi loan was for 1,500 but unfair bank charges brought it upto 2,500. Debt agency has reduce the debt by taking off the bank charges as I contested the whole debt on the court paper.
