Hi
Has anyone fought an IPA and what happened?
Im being asked to sign one despite still being on income based JSA and working an hour a day term time only (& yes they can ask as its income!)
Ive got the Debt Doctor giving me great advice from on here. But just wondering if anyones fought one and what happened or if they left you alone?

Hi there
I know that you're seeking personal experiences as opposed to general advice, but as no one has come forward yet I just wanted to offer a point or two.
The "A" in IPA stands for Agreement - if you can't find common ground with the Official Receiver, they will most likely apply to the courts for an Income Payment Order instead. This would result in a hearing which you are free to attend in order to present any arguments you have as to why the order should not be made.
I hope you can get some first-hand feedback, but those who have disputed IPAs/IPOs all the way to court will be a very small cross-section, and every case will be different.

I would take issue with that "most likely".
If the proposed IPA is unfair, then it would be very unlikely for the OR to go to court anyway. In most cases they back down rather than have the embarrassment of a try and fail, and possible telling off from a judge.
The statistics show just how rare attempts/success on IPOs via the courts are.
2014 - figures approx
Bankruptcies = 20,300
Voluntarily IPAs agreed = 3,800
IPOs granted/imposed by the courts = 39

You know when you just know somethings so crazy it cant be right?!! Well thats my situation.

I agree with Fermi.
According to a recently former level 2 examiner of the Insolvency Service now in my debt team, court action to challenge a non agreed IPA is very rare.
No guarantees though!

Hi we have been in a similar situation. We had a ipa which was our surplus.however we seemed to struggle each month and not living extravagantly . When we were expecting our second baby I wrote off to ask if the ipa could be stopped as obviously more money was going to be needed to buy essentials. Well I was made to feel a fraud and that I needed to prove I was pregnant. The company dealing with the ipa on behalf of the OR said i could buy things but then s3nd receipts ect. I found this hard as obviously pay goes down whilst on mat leave so wanted to put a little aside. Apparently I couldn't be reassessed until the baby arrived as circumstances hadn't changed. How they expect you to keep head above water is beyond me. However i then went to the OR who got me to fill on income questionnaire and i found a useful expenditure on citizens advice website for bankrupts. So that you don't underestimate your outgoings and what is deemed reasonable. I filled it out and the OR had no issues with it and stopped the IPA. definately use citizen advice website really useful xx0
