    Thankfully it seems that Amigo inform the guarantor when the borrow fails to make the repayments.

    I think the OP means that the interest has been frozen rather than capped but what would I know, I'm just a bozo.
  • all i can say is good luck to the unfortunate guarantor....

    he is going to need it. Lets hope his wife/other half knows that he has been guarantor for this... situations like this can easily break up lives. an, in the wors of the OP, well he can happily "jog on" leaving the trail of misery behind him.

    OP my advice would be to try and pay the full amount, even if it means some hard cutbacks. And keep the guarantor informed every step of the way.

  • I am a guarantor for an old friend since the loan has been taken out we are no longer on speaking terms. The past 4-5 payments they have missed and I am sat here paying it for them. If I was to clear the loan would I win in a small claims court to retrieve all the money from them? And help with this will be highly appreciated.

    Probably not. You agreed to meet the person's repayments. You (presumably) don't have an agreement between you and your friend saying he would owe you the money.

    Even if you did, and if you did take him to a small claims court, and even if you won, you might not get any money back. Particularly if he doesn't have any money to give.

    You could well win; if, however your former friend doesn't have the money you still might not get it. Given the repayments aren't being made it look like the money isn't there.
