Mortgage Broker Fee refund if they didn't actually do their job?

    How about this for an alternative scenario?

    Broker sends all of your files to the lender. The lender misplaces them. You call the lender, and they tell you they haven't received the files. The broker assumed in good faith that the lender was working on the files.

    Why assume that the broker was lying?

    I looked at my answer as a broker and as a potential customer.

    If I felt I was getting a poor service I would bring it up at the time and expect something to be done about it; or as I suggested, we'd decide to part and I would not expect any more work to be done on my case. The OP has decided to keep quiet and now start looking for ways to avoid paying.

    I'm not disputing the poor service, I've an issue with leaving it until the point of payment, then coming up with reasons/excuses which are over four months old.

    Once again our profession is blighted by clowns in estate agencies, but in this case, they should be paid due to the OP's inactivity in raising the issue at the time.

    IMHO, of course. OP can try to raise issue now.
