Ex has broke court order

Broke up with my ex 6 years ago was civil til he remarried and his attitude changed dramatically........he pays his basic maintenance of £400 a month still does to this day

But as part of our divorce he was ordered to pay by the courts £66 extra a month to cover the kids lunches and to pay half of their school uniform costs

Last contact from him was January 8th 2013 saying he could have the kids that weekend due to work commitments which is fair enough but that's the last we've heard from him

In August 2013 in posted a copy of the receipts along with our new address (moved round the corner) but stupidly didn't send it recorded delivery (just had a baby head was all muddled) but never heard anything then in May 2014 the standing order of £466 had been reduced to £400 again no form of communication from ex

Lawyers who were dealing with my case have went bankrupt and I'm not sure how to pursue this, he's military so he's easy to track down kids don't want to know him as this is the second period of time he's gone awol from their lives which is a shame as he has unlimited access which I insisted on

So am I best to contact the court who dealt the court order????

    I believe that after one year court orders are not relevant.

    How much should he pay using the CMS calculations?

  • just wondering what your paying, hes paying £400 a month wow, then on top of that hes paying for their food and also school uniforms, what do you provide

    What with the cheek????? I was asking for advice not a flipping troll who's nothing better to do with their time to go through posts that are nearly three months old.

    Money doesn't replace a relationship with his children because he chose to not have them in his life anymore which is pathetic so I provide them with everything they need whilst ensuring I have a great relationship with my kids and reassuring them I will always be there for them unlike their father.

    Like I explained he is no longer paying for their school meals or any of their uniform which was ordered by a court judge......I work between 55 to 60 hours a week if you want to be nosey!!!!!

    Do you know how expensive kids are???? £200 a month doesn't stretch far for each child especially with clubs that they attend so if you are not going to offer helpful advice I suggest you button it!!!

    My ex who I was with for 12 years of marriage earns over £45k a year so I don't think £400 a month plus the stuff the judge ORDERED him to pay as extras is unreasonable so crawl back under that shell of yours!!!!!

    rather than losing your rag, do the sensible thing.

    The court order is no longer valid.

    Either accept the payment he is making or check out the likely amount you would get via CMS. If you would get more via CMS, then write to him keeping it very short and sweet, no emotion, and give him the option of paying voluntarily or via CMS.

    How can it be no longer valid when in the court order he's being ordered to pay for half their lunches and uniforms until they are 16 or longer if they are in further education??

    If you click on the trolls name you can see they have a habit of trying to wind people up on the child support section xx

    I would love to write to him but he's moved from his last posting and hasn't informed myself or my kids so I have no way of contacting him as he's changed his phone number and email address so go figure xx

    So he is forces? I would check out making a CMS claim in that case. Ignore the court order.

    you can check the CMS website to see approximately how much you would be entitled to. If its about the same as what you are (should be) getting now then do a claim with them. It will pretty much void the court order but you should actually get what you are entitled to.
