am BR - any idea what would happen if I won a discrimination case while undischarged?

Hello everyone,

Get yourself a brew, pull up a chair and I'll fill you in...

As some of you may remember, I went BR 2 months ago (and thanks to all of you who supported me through that difficult process!)

I have recently returned to work following maternity leave, only to find that my boss is treating me very unfairly. To cut a long story short, I seem to be on the receiving end of sex discrimination and a tribunal looks likely.

Here's the thing, if I am succesful in winning my case (assuming boss allows things to go that far) I will be receiving compensation for loss of earnings and to allow for the fact that I will need to find other employment and will probably never be able to get a job in my industry again. Bearing that in mind, if this all takes place before I am discharged, will the settlement be taken from me?

Does anyone have any idea? Please? :confused:

  • Tech as I understand it any income that you receive while undischarged can be grabed by the trustee with the exception of what is necessary to live on

    What do honestly think the chances are of it being settled within the next 10 months i wouldn't think they'll rush that, not too sure about this next bit but i think if you don't disclose you coming into some money while your bankrupt they can apply to 'keep you bankrupt longer' - their no doubt is a correct term

    Blardy 'ell. But it's all going to be necessary to live on, I have virtually no income and would have to make that last for the forseeable future, not to mention needing to repay DP as most of out outgoings are currently funded by CCs thanks to my stupid boss...
  • I don't know how it applies to you, but i did a compensation case. From beginning to end it took a little over 18 months so you'd have no money to live on for a long time anyway.
    It took another 3 weeks and 6 days after the case for the cheque to arrive-they had to send it within 4 weeks.
    The first time we said hello, was the first time we said goodbye. As the angels took your tiny hand and flew you to the sky-you forever left us breathless. RIP my beautiful granddaughter :(

    The only info I can find so far is this, regarding "After acquired property".

    Compensatory awards made by Industrial Tribunals are considered to be property rather than income and can thus be claimed as after-acquired property.
