    So do they need the original paperwork to go to Court? Could they use a reconstituted agreement?

    They said they are going back to Arrow to chase up the paperwork and will talk to them about what to do next.

    It's so annoying that I will be in a position next year to pay them off (hopefully at a reduced settlement).

    Technically they don't need to have an original agreement, they would however need to convince the court the agreement did exist, they could do this by various methods, however, this would be time consuming and costly, and they may not have the inclination to follow through on this.

    Usually if no agreement exists, a creditor will not pursue legal action because of the legal complexities involved in pursuing the case.
