    I would assume, NZ, that the post refers to 'Outstanding Fines' at time of bankruptcy. :confused:

    The Parking Penalty Scheme

    Parking penalties in London and many other local authority areas are dealt with differently if the local authority runs a "decriminalised parking scheme". It is likely that other areas will follow soon.
    The local authority will send you a parking ticket for a fixed amount. The penalty is then registered in The Traffic Enforcement Centre at Northampton county court as a judgment.
    This would suggest that some parking penalties (especially fixed penalty ones) are dealt with through systems other than the magistrates court, and so may be provable under the second part of the guidelines quoted:
    Fixed penalty notices issued on behalf of a local authority, including those in relation to the London congestion charge, are not fines for this purpose. They should be treated as provable debts and will be released on discharge from bankruptcy.
    It is this point that merits querying with the OR/IS.

    It may well come to nothing, but as always if you don't ask.........

    EDIT: I posted the quote that Erikin found in this thread yesterday myself, but then removed it as I didn't want to confuse the situation until I knew exactly how a real OR would interpret it the light of the systems in place for parking enforcement in London now.

    Unless it came under the following definition from the Magistrates Courts Act I would argue it was a provable debt.

    “fine, includes any pecuniary penalty or pecuniary forfeiture or pecuniary compensation payable under a conviction”. Conviction is the key word.

    Unless going bankrupt this is an academic exercise but if in doubt enter a fine on the list of creditors because it would be resolved without problem down the line.

    Tis all good news - will put it on my list of creditors for the OR to sort out and you never know a) they might have let me off it anyway and not told me yet b) the OR wil tell them I've gone BR so they can't have anything c) The OR will tell me it doesn't count in which case I write to them again once they have issued me with a 'pay £80 NOW' bill and say, sorry, can't in one go I'm BR - can we cme to an arrangement :D
