Jacobs bailiffs not accepting payment plan

Hello everyone please bear with me

I have an unpaid council tax bill of £700 I had a payment set up with jacobs to pay £110 a month, my husband had his wages cut so i missed last month's, two days ago I had a 48hr removal letter or payment in full, tried to call and straight to voice mail bill had risen to £947

Today knock at the door and a letter saying he will be back at 5 to start removal, I've contacted him and the council and his office, he said there is no way he will let me have a payment plan again after missing the last (Yes I know this is my fault) and I will see him at 5

I've offered to pay the £110 a month but he won't accept and I don't know what to do, I know this is all my own doing but I feel lost and need help.

I've already locked doors and windows, secured shed and closed the curtains, the car isn't mine it's my husbands aunts, log book and finance details are all in her name and we were just borrowing it as we couldn't afford to buy, do they have any rights to this?

Please I don't need a lecture I've had enough of them today and with severe tonsillitis and two children under five I don't know how much more stress I can deal with thank you in advance x

    Sounds like everything's in place then - you know that they cannot force entry unless they have previously been in and 'taken control' of goods.

    No they have no right to a car you don't own but if it is on your drive they may clamp first and ask questions later. Hope that wasn't an issue. Park it a little way down the road or (better) on someone else's drive or land.

    Carry on making the payments and this will probably blow over. There will be the full £310 fees on this now though.

    It can be difficult to negotiate in these situations, try not to worry (easier said than done, I know). You seem to have taken the right precautions and Fatbelly gave some good information too. Because your circumstances have changed you were probably going to need to change the arrangement with them anyway, as opposed to paying them £110pcm.

    So do a new SOA and send it to them in the post; make them a new offer based on what you can realistically afford now. If they reject it then save the money to one side at home until you have enough to clear the debt and their fees. In the meantime, avoid negotiations on the phone and face to face and keep your home and assets locked and secure – which you already seem to be doing anyway. (Please bear in mind that if they have been inside your home before you will need more detailed advice about tactics).

  • I had an agreement with Jacobs for £92 every 31 days in December 2015, due to loosing one of my clients I am now down £34 per week. I contacted Jacobs to sort out a new payment plan and expanded everything but they had non of it. I was even willing to do another income and expenditure but they were having non of it.
  • They will make 3 attempts to collect and then abandon the collection, the council will then make a payment plan.
    They can not force entry for a civil debt.
    They can walk through a unlocked door.
    I do Contracts, all day every day.
