Legalities of Pay

Hi,
For obvious reasons I wont be naming any companies here...
I work for a company we shall call X which is a child company of Y. Y manages multiple sites under their own name as well as us. Now the staff of X have mixed contracts, some have contracts that state company X and some Y.
Recently Y have announced, internally, that all their staff are to be paid the living wage across all sites. However the HR have said this will NOT apply to worker of X, despite us doing the same job for the same parent company (indeed our job description has us doing more!).
Legally where do we stand as to the wage increase? Cheers for any advice.

Well I was more hoping for advice from people in the know BEFORE going to spend money. What with this being a money saving board and all. Given they are paying minimum wage and are not discriminating for legally protected characteristics don't see how this can be against the law.0

You don't stand anywhere, they can pay what they like as long as it's NMW or above. If you don't like it get a job with company Y.0

they are entitled not to make the same offer to the employees of X.
However, if they are seeking accreditation via the Living Wage Foundation then they are supposed to make commitments with regard to contrators as well as regarding direct employees, and I think would have to pay you and others the living wage in order to qualify.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
Yeah that's pretty much what I thought, even though its them that pay me I assumed I'd not be automatically entitled to the higher rate. Always worth asking for opinions smarter than mine.
Oh, also we have started organising getting the staff into unions.
