Are Bryan Carter Solicitors just being stupid?

I'm paying off a CCJ at £50 per month and have not missed a payment since I started last year!
It's all automated via a regular payment from my HSBC basic account to my Barclays basic account which then goes out to BC sols.
But now I've had the " arrangement between us has now ended", "The County Bailiff will be instructed" letter on the mat this morning. Thought I didn't read it till this afternoon as I work 8 to 12 Sat morns.

The letter states that they wrote to me previously, though I did have no knowledge of that letter.

The only change happened in May when Barclays charged me £8 commission in April, but payed it back due to a misunderstanding.

At that time I altered the date of the outgoing payment to BC sols from my original 5th of the month to the 10th of the month. The next month, they payed it out on Monday 11th instead, with it being required on the 13th.

Yes, I can see that the payment may or may not have cleared at the end of three days, but . . .

So, they've had the money, but will send the baillif anyway?
They advise me to seek independant legal advice.

Well. I feel less grumpy now that I've typed this. So thanx for any ideas. Though I shall be phoning them on Monday morning to, hopefully, clear it up. :)

    What is the basis of paying of the ccj at £50/month? Is this the court order or is it another arrangement?

    From your statement it looks to me like you missed a payment in February. The narrative on the credit for 2nd Feb suggests that the standing order was reversed so you have not paid that month. The £8 fee probably relates to this too.

    OP is quite clear about how the money goes into the account shown - it is automated - and as both accounts are his, he is in charge.

    But what we really need to know is how the payments are made to BC are they SO in which case OP is responsible or are they DD in which case BC is responsible.

    And leaving aside the £8, why was the payment of £50 to BC on 02:02 reversed on the same day? If BC did this then BC are responsible for the missing payment. If OP or his bank decided to reverse, then OP is responsible.

    Seems it was a male chicken up, partly my fault, partly Barclays. I originally wanted the payments going out on the 7th of each month as the transfer went out on the 3rd, but Barclays set it up as a "First Monday of the month", so it glitched when they tried to pay BC on the 2nd of Feb, before the money came in on the 3rd.

    I spoke to BC's phone in people this evening and it's all sorted. The guy on the line did note that the payments had continued regularly after Feb, so that went in my favour. :)
    They're sending me an email with a link to let me register on their website, then I can also make payments there if necessary and will be able to clear the 50 arrears.

    PHEW!!
    BLIMMIN STRESSFUL WHEN YOU GET THAT SORT OF LETTER THOUGH AINT IT!!!!! :(

    Thankfully I didn't bark at the cat.

    Time for another cuppa. Anyone got any choccy biccies?

    Yes, that originated via the CCJ, but the amount was my choice.

    You are indeed correct.
    It was a misunderstanding.
    One of my (recently realised) biggest probs is that I genuinely fail to focus on any page containing accounting or strings of numbers.

    Forget Sudoku! :eek: But it's no joke if gets me into this kind of fix.

    It was a team effort. But, in spite of my sig on this forum, the folks at the Exeter Barclays branch are very nice. ;)
