How to remove yourself from a mortgage after split

Partner has an interest only mortgage with his ex which was 76,000 and is now 80,000. They split in 2008 but it's been left due to numerous reasons, we're now wanting to purchase meaning he has got to come off the mortgage as his wage will only qualify for one mortgage.

Problem is is that she's solely on benefits and she is currently in arrears with the mortgage so we don't think that the company will let her take the mortgage over herself. House was bought for 102k with a 40k deposit, there's no equity left in the house and it's been valued at 102k again earlier this year (she tried selling but didn't want to take less than she paid.)

He doesn't want anything out of the house apart from to be off the mortgage. At the min it seems impossible and seeing a solicitor will cost us a lot of money, so any advice or information would be greatly appreciated.

Is there anyway he can just relinquish himself from the mortgage or has anyone else been in this situation?

    In a word no. The only options are for her to get a mortgage herself. As it stands they are both in arrears on the mortgage so I would not hold up too much hope for the both of you getting a mortgage together any time soon, have you both checked your credit reports, if not do it now.
