Carbot playing tricks .

CARBOT are playing tricks with accounts . Had a letter claiming that the original owner of a debt had applied a fee incorrectly. They claim that a refund has been forwarded to them and were now sending a cheque to me, claiming account is still active . If its what I think it is , it would have been statue barred five years ago! I BELIEVE they want me to bank the cheque and by doing so, some how reactive their claim . I,ve just put a line through it and returned.

    Once it is statute barred I don't think they can then change the status and try and legally pursue you for the debt even if you did in future acknowledge the debt.

    Is it definitely statue barred?

    Correct, once statute barred it stays that way.

    "a right of action, once barred by this Act, shall not be revived by any subsequent acknowledgment or payment"

    Besides, acknowledgement must be made by you in writing, or payment by you.

    How much was the cheque for ?


    As the others have said, the statute barred status cant be changed, I`d bank the money if I was you.

    Was for £50 . This would then provide a paper tail for them. Last payment would have been something like 8 years ago.

    So same advise still applies, once statute barred, always statute barred, nothing they or you do, can change that status.

    Another letter , with Capita on the back received. A quick look at website tells me , they are a full of !!!!!!!! company , management of accounts etc blur blur blur .
    Looks like photo copied heading , saying Bank of Scotland .
    Says we noticed you have not banked cheque . Well they also did not notice , i put a line through it and sent it back !
