Do I mention the Bank Account?

Hi

Just completing the forms for my BR. I have a problem that I would appreciate advice on.

Originally I intended to go for IVA and as my bank account was with a creditor I set up a new joint account with Natwest (Step account - basic cashcard account) in joint name with my wife. I was then advised that BR was a better option for me and we changed the joint account to wifes name ONLY. I have arranged to have my income (DLA Income support) paid into it and that is no problem.

My question is, since the account was only in joint names for at most 2 weeks in June do I really have to mention it on the BR forms as I am sure natwest will close it if they get a wiff of my bankruptcy and we really need this account. Should I just ignore it, or must I mention it even though I officially and in reality have no connection with it anymore (statements etc are all in wifes name)

Your advice would be greatly appreciated

If you want to be really 100% exact to the letter of the law then you should declare it.

However, since it is now is your wife's name only and only had your name on it for a matter of weeks I wouldn't be too stressed. The Official Receiver will only be concerned with such an account if they think that you have siphoned off funds into it (which you haven't I presume). Personally I wouldn't mention it since it is no big deal, and as you say Natwest can be awkward to say the least about bankruptcy.

If you are really worried then you can get benefits paid into a "Post Office Card Account" which is never frozen or affected by bankruptcy since it is for benefits only.

Yep. It is something that could easily slip your mind given the stress of the bankruptcy process.;)
