Based on your perception that a lender is merely issuing a piece of paper. You appear to lack the business knowledge to understand why charges at set at what appear to be high levels. I'm sure that the appropriate regulatory bodies do monitor such charges for a level of reasonableness.

Yet another bank defender appears on the scene - Pathetic.
  • As far as I am aware, nobody on this thread is a friend of the banks. We are simply highlighting flaws in your arguments.

Your response is to insult them with false accusations.

But it in any case it will cost them a lot of money to go to court, just paying up may be the cheaper option.
No doubt something to be applauded by moneysavingexpert.com!

Why would Barclays PLC not want to defend their mortgage arrears fees in Court ?
The two claims i know of total in excess of £18,000 - so please don't insult me and say it's cheaper to settle than attend a small claims court.

If Barclays PLC think their mortgage arrears charges are acceptable then why
do they not put this to be bed and defend them in Court ? especially if they have the FOS Ombudsmen decision supporting them ?

Not defending the banks. Just picking holes in the basis of your argument.

£18,000 exceeds the small claims limit.

The OP is not in dispute with Barclays.

The OP is not in dispute with Barclays.

£18,000 for two claims does not exceed the £10,000 per claim limit.

I am talking about court action taken against Barclays Bank . The OP is in dispute against a sub prime lender and i have advised what course of action he could take.

Okay. However, in that case, the claimant wanted >£9k. Barclays offered around £1,200.

That seems to prove molerat's point.

And the relevance to the OP is what since,

Recommending they now take the lender on in court over an issue where FOS has already found against the OP and in favour of the sub prime lender sounds like sub prime advice.

Why would Barclays PLC not want to defend their mortgage arrears fees in Court ? Please don't give me the usual claptrap ' cheaper to settle out of court'
Barclays use para legals when defending in a small claims court.

Why do you keep giving the usual claptrap about Barclays when the OP's dispute is with somebody else?
