    Yes you are correct in that assumption for pre April 2007 agreements, sorry if I did not make that clear.

    My CCA letters are ready to be posted but I have a question.

    Chequers are enclosed for the fee. Is the fee taken for providing a CCA or just for looking fir it?
    Also, the chequers are from an account I wish to close soon. What's roughly the timescale of these being banked/used?
    LBM.....sometime in 2013 £27,056. 10 creditors
    June 20.....£7,587.....3 creditors left 72% paid

    £26,200 on interest only part of mortgage (July 16)...will chip away £17,103
    £49,200 repayment mortgage ( July 16) £37,764

    I think postal orders would be better than cheques as they don't have your signature on.

    Hi everyone. I just need advise on what todo from here before I ring stepchange Monday.

    I've been On a dmp since last June and always paid stepchange by direct debit on time, anyway today I received a letter from one of my creditors (lloyds) saying my plan with them has now been cancelled, because they have not received payments.
    Yet the money has always been taken from my bank on time every month on the 1st, as I always check my balance on the day it should be taken.

    So what will happen from here if any of you have had this issue before?.

    By the way I will ring stepchange on Monday as lines are closed over the weekend for current dmp clients.

    Hi All,
    It has been sometime since I visited! I started my DMP three years ago and the forum was fantastic and got me through some very stressful and confusing times! My DMP has been running smoothly, and is set to go on for quite a few years due to the amount we were able to pay each month, it does feel like a very long tunnel at times! and I won't pretend its been easy, my budget is very tight. On a good note though, we haven't taken on any more debt and are just managing on what we have. I don't sign into the site as often as I used to, as to be honest I am rubbish at my passwords and always have to reset them!!
    Anyway, to bring me to my question, we were just recently considering if we would be in a better financial position if we moved home. Which led me to reset my Noddle password and log in. My credit rating is 1 out of 5. We have never defaulted on our mortage and have two HP payments we have also continued to pay without default, so I thought it might be better. Anyway, when I looked at the report, 5 creditors are showing as a red default for every month over the past three years since we began our DMP and Lloyds only started as a defaut last year and have been every month since. I didn't know if this was normal? Maybe I understood it wrong, but I thought once it was registerd as a default it wouldn't continue tobe each month? Does this then mean we have to wait 6years from the DMP ends before the default leaves the credit file?
    Any help would be appreciated!!

    Out of 8 cheques sent since mid march only two have so far been cashed.

    I partially agree with puzzcat re postal orders versus cheques but since each postal order costs 70p it is a lot cheaper to write cheques. The way we did it was I signed the cheques for DH's debts and he signed for my debts. Then we only needed postal orders for two joint debts.

    Check that they have the correct details. We got a letter from one of our predators that said similar. SC said the payments were not being returned to them which is what usually happens if details are wrong. Turned out the predator had changed the reference number they used for us without informing either us or SC but were still accepting the payments under the old reference. They just weren't matching them up.

    They apply the marker for each month but it should all disappear six years after the default date. I say should because I have noticed that crabot have changed the marker they have been using from a default marker to a dm - debt management marker this last three months. The actual default date shows on the record though so hopefully it still goes by that.

    The fee is for the search and provision of a copy of your credit agreement.
    The statutory fee is best paid by postal order, although if you've done the cheques then send them.

    It can take 40 days plus to provide these copies, just leave the account open till each creditor has either complied, or said they can't comply.

  • Just a straw-poll really as so curious about others' experiences and you are all so helpful and candid. We recently started a DMP and with almost £100k of debt nothing is going to happen quickly. However we have certainly been fairly treated to date and all creditors seem to be getting on board and with suspending interest and not harassing on the phone etc.

    Anyway, here's what I'm wondering - has anyone had a charging order while on a DMP from a creditor who you had a payment arrangement with? Did it come out of the blue? Why do you think they did it?

    I know that creditors generally take legal action when they are getting nowhere with you, but I do wonder why more of them don't place a charging order as soon as possible when a debtor has a house and is paying a low DMP payment or even token amounts.

    At the end of the day, if they do get a charging order then they don't need to accept a low F&F way down the line, or a ridiculously distant DFD....they must know that most people will sell their house eventually and they will get all their cash.
