I recently had a letter from Lowell saying I owed £600 from a bank account years ago (had a £100 overdraft the rest was from charges). I wrote a letter claiming it was statute barred,which it is. The have written back to me saying it isn't statute barred because I made a payment of 1p on Christmas eve 2009, thats 1p on Christmas Eve.
What would be the best course of action to take now?

Tell them to jog on...was that a credit of interest by any chance? That doesn't count as a payment.:footie:

Inform them that the parties are now in dispute for purposes of the FOS and if no satisfactory resolution is found the matter will be forwarded to the FOS on a complaint of fraudulent and mis-leading statements and practices .
They do not need you to tell them what counts as payment, they already know.I do Contracts, all day every day.0 -

Remember, they have to "PROVE" you made the payment, word of mouth, or hearsay, is not sufficient, a payment by a 3rd party would not count, write back and "remind" them of this, and reiterate the account is SB.
