Not happy...

Hi Everyone,

We have a completion date of 31st July. We viewed the house twice back in May, it had been vacant for 8 months at the time. It had some appliances such as fridge, washing machine, tumble dryer and 2 wardrobes upstairs, we were told by the estate agent that this was to be sold as seen. You see where I am going here????

So we get all searches back, then I also check the fixtures and fittings list, that's when I notice only the tumble dryer is included everything else isn't included. I asked to go back and view the property again and now everything has been taken so they sellers have been back to take it all.

I'm wondering if anyone has ever had this happen or have any experience around this sort of thing? Obviously I don't have anything in writing about it being sold as seen however we aren't just talking a few quid, talking near enough £1k.

We haven't exchanged contracts yet.
Any ideas on next steps?

    Your not really talking near enough £1k unless those items were brand new?
    If they had been used then you are probably talking a couple of hundred - look on ebay?

    Putting that to one side, if you are unhappy then you need to go back to the agent and try to renegotiate the price - or try to. If you the price is altered, then you will need to go back to the lender and ask them to alter your mortgage offer to reflect the new purchase price.

    Its worth also speaking to your solicitor.

    I priced everything up as 2nd hand, your talking roughly £750 to £1k. Wardrobes looked pretty much new and were huge as well as the fridge.

    I can't understand why the sellers would go back to house and Estate Agent wouldn't mention anything to us knowing they had said sold as seen but hey ho, that's another issue.

    I am considering renegotiating the price or at least coming to some sort of arrangement.

    are you buying a house or someone's contents?

    I would never buy a house at any price on the strength of their possessions. If they are minded to remove things they are probably minded to tell you where to take your down valuation. Did the survey come back at the price you are paying?

    I see where you are going and it is probably something of a blind alley.

    Sold as seen refers to the house and has no bearing on moveables such as those listed. Of course, if any of them are built in it is a different matter.

    Fixtures and fittings can be considered items that would not drop out if you turned the house upside down and shook it.

    Anything that was to be included in the sale would be listed as part of the preparation of sales contracts.
