Confused with Cabot/Marlin

Hi All,

Just looking for some opinions on what Cabot/Marlin are up to....

Quick background:

I queried an old debt (around 2005) that I believed was not mine, after a while they provided a signed CCA and supporting paperwork.

The story behind how the debt come to exist is long winded and I won't go into the details here but the bottom line is legally the debt is mine.

I then offer a monthly payment to clear the debt, the balance is just over 5k and my offer of payment was just under £6.

I have made the 1st payment (25th June) and on the 1st of July I receive a letter offering 50% off my balance to clear it on a full and final basis.

Now, I am not too sure what to make of this as they have the paperwork to enforce the debt if they wished unless I missed something.

Are they looking long term and want to get as much as they can quickly or is there something more sinister going on?

I don't have the money to clear it at the reduced offer amount hence the monthly offer and won't be in a position for a good few years to raise the money either.

Many thanks for peoples opinions/experiences with this company.

    So, before you stated making payments was there a period of 6 or more years during which you did not make a payment or acknowledge the debt as yours in writing?

    I was not making payments but payments were being made... this is the messy but irrelevant part.

    Err, it may not be irrelevant, this account could be statute barred, hence the 50% discount offer, you/we need to know when the last payment was made, and/or, has there been a period of 6 years without payment ?

    It also may matter who made the payments and on what authority. For example, if a joint debt then payments by the other person liable may restart the clock, as may payments made on your authority by an 'agent' on your behalf.

    This account is not SB as payments were made in 2011, Cabot have provided evidence to support this.

    The payments would have come from my now ex who would have been in control of the household finances when I was in hospital long term.

    My question really is why offer a discount when they have all they need to get a CCJ etc...

    That's an interesting question, and I cant give a definitive answer, could be they want a quick resolution, after all, DCA`s are in the "get rich quick" business, was the CCA legit ?

    It looked legit, they provided original credit agreement, and it was an agreement not application.

    They also provided old and new terms and conditions.

    I am just surprised at what they have done as they were playing hardball as soon as Marlin took them over.

    It may have something to do with the official complaint I raised due to them contacting me when the account was on hold threatening legal action.
