Council tax

Hi all,

So on Wednesday, I filed for bankruptcy and so glad it's over, well will be once I have my interview with OR next Wednesday.

Just have a quick question, I've never been behind on my council tax but today my girlfriend got a separate bill for the council tax. It was in both names but now a whole new account has been set up with my name taken off. Is this normal? I didn't know my account would be closed after going bankrupt.

    They'll have done as your bankrupt and they'll pursue your girlfriend solely for anything due up to the end of the council tax year.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    Shame it wasn't just in your name - it would have been included in BR for the whole 12 months until March 2016.
    Just one of those little ducks to line up before BR :)

    Thanks, surely that would only count if you live alone? Do you not pay council tax after going bankrupt then if you live alone? Also can anyone give advise on utility companis, I also got a letter from water company today saying they know I am bankrupt but it won't affect my acount. Are others like gas, water, broadband and mobile like to have an issue and maybe closed my accounts. I've never been in arrears with these.

    Thanks, surely that would only count if you live alone? Do you not pay council tax after going bankrupt then if you live alone?
    Effectively the bankruptcy covers you only and the council will bill any others jointly liable (bankruptcy introduces some strange issues in to council tax).

    If the council were on the ball they'd check for a resident partner (and correctly) bill them.

  • I live alone and did not pay council tax during my BR. I only realised after a few months of paying so I had to re do my SOA and submit to the OR. My IPA was then increased accordingly for the remainder of the tax year. The OR did let me keep the £160 refund though from the council.

    I wouldn't have expected bankruptcy to affect your water account, even if you'd owed them money, as your supply cannot be disconnected or restricted over arrears.


    I wouldn't expect it to affect your existing entitlement to any of the other services you mention, either. Utility companies can (and often do) report account information to the credit reference agencies. If your payments to them are up to date, they're unlikely to withdraw or curtail services just because of the bankruptcy - it will have no effect on them.
