    listen very carefully i will say this only once. " you can apply to the court for refusal of a charging order for any reason. There are no specific guidelines it is a matter for a judge to decide on the merit of each case which means it is NOT a foregone conclusion it will be issued.

    Agreed it is likely but not cast in stone.

    For the record i am fully aware of how to write english and to formulate a sentence. i thought this was a forum not an english lesson. if all you can do is resort to criticising peopels writing abilities i guess that sums you up in one.

    So we agree that as in my previous post (which if you had read properly you would have seen) that if all paperwork is in order and if there is no suitable defence (of which we agree there aren't many) then the order will be granted. As I put it the judge will be obliged to award the order in those circumstances - how can it be any other way ? I have never disputed that the order can be varied only asked specifically under what circumstances - I really am interested to know.

    It's a shame it took you so long to understand, I suppose it might have something to do with your grasp of our language.
