Advice needed

I was made redundant in 2005 and my partner left me shortly after. I tried to keep things going as all credit cards and loans were in my names, but finally was forced into bankruptcy at the beginning of 2006, and was discharged three months later.

I have got myself back on my feet, and now own my own home. In the post this morning I received a letter from one of the companies which I had a loan with at the time of my bankruptcy.

The letter states "In 2005 we applied a charge of £50:00 to your account, when we arranged the transfer of your debt to J&J Collections which we should not have charged you. I'm sorry that we applied these type of transfer charges in the past and this is to let you know that we are committed to putting this right, by refunding this fee and making a compensation payment to you.

We have contacted Max Recovery who have informed us of the status of the account.

As the account is still active, we have asked Max Recovery to credit your account with this refund and a cheque for £50.00 is included below to cover any distress and inconvenience this may have caused you.

This payment covers your refund and compensates for any distress and inconvenience the charging of these fees may have caused you. We're aware that some customers may have incurred other costs when the fees were charged. for example where you may have borrowed funds to cover payments or incurred charges, so please get in touch if you were also affected this way."

How they got my new address is beyond me, and surely this money should have gone to the OR as it relates to a pre-bankruptcy account, also why is my account still open with Max Recovery 10 years after I was discharged?

What should I do?

  • I've had the same letter as well.

There is another thread that I found on the forum regarding similar letters. As I'm a new user I can't post a direct link but if you use the search function and search for BOS refund cheque it will come up (Its in the PPI reclaim / Bank and Credit Card charges section).
