Court win against District Enforcement, Trafalgar Wharf, Portsmouth

On 18th June 2015 I won the court hearing against DE Ltd for a parking ticket received outside Victory Dance School, Trafalgar Wharf, Portsmouth.
I had appealed against the ticket with the so called independant Parking Commitee (IPC) who went in favour of DE Ltd stating the signage WAS clear. So they pursued me to Plymouth Court Court.
The witness KURPIL of DE Ltd sent a legal rep to Plymouth County Court, who could not answer any of my questions in cross-examination. The case was dismissed on the basis of unclear signage.
Out of the 12 spaces at the location, 10 were allocated to the lease on Victory Dance School and 2 allocated to the lease of Waterside Cafe Bar (I was the director at the time) Due to it being multi site parking it was not clear cut. The legal rep couldn't supply a copy of the lease or anything to prove the spaces were controlled by Victory Dance School. The signage did not span the 10 spaces and because there was not an entrance to the parking area the signage was unclear.

If anyone else is fighting a ticket at this location I would be very happy to help. My case was District Enforcement Ltd v Katrina Margaret Foot for info.

I am so delighted to win against these cowboys!

Very well done, the parking prankster is very much interested in iffy IPC/IAS decisions maybe you could send over the IAS refusal and the court case details.

Seems the independent assessors believing the auditing of the signs by the IPC were not as good as the Judge clearly thought they were not.

I think it's now an 'uno'. Just Dyl Kurpil left. The other two have decided to get proper jobs!

Well done Katmf, they're a difficult outfit to deal with. Your offer to advise others facing similar interactions with DE is very helpful.

I hope you put in a claim or counter claim for costs, since if the initial or IPC appeals were upheld you shouldn't have had to go to court.

I'd also complain to the SRA about the impartial appeal from the IPCs solicitors which was contradicted by a court.

Yes I will send over documentation to the parking prankster as requested :-)

I didn't put in a counter claim. To be honest I've found the process quite stressful so I was just happy with the result and the fact it has cost DE a fortune to pursue me! :-)
