    The district judge has indicated this should go back to the mediation service, so I have e-mailed them to tell them I think they should make sure they secure the appointment this time to resolve it through the service.

    They have come back and said they want to know my response on their offer before they go to mediation so they know whether the service will be beneficial

    I feel like saying I am not willing to give a response until mediation, I don't want to tell them straight up no and so they don't opt for the mediation service

    Tell them that their offer needs to come through mediation and not outside of it. Tell them you are not comfortable with them trying to negotiate outside of mediation.

    from the sounds of it, they want there cake and eat it, if there asking outside mediation it sounds like there trying to get some costs.

    Are they trying to obtain a sneaky admission of at least a partial admission of liability from you?

    You could always refer them to the defence given in Arkell vs Presdram ;)
