Urgent help please CSA..

Hi,

This is for a friend with three kids.

Hubby is now refusing maintenance and has told her to go through csa.

He says the take into account his debts and its now only done on his disposable income left over. Is that true?

    They don't take into account his debts - think for 3 children it's 20% of income

    If it's a new claim it will be based on his gross income. There would be a reduction if he has a child living in his household but no they don't take debts etc into account.

    new claim would be on gross scheme. Debts are not taken into account. Infact, all that is taken into account is how often kids stay with the NRP.

    The ex is a piece of work that is full of it. He's being very aggressive and trying to bully her.

    Much appreciated...

    Can you just confirm the charges. Would he have to pay a collection fee?

    What would the total amount roughly be on say a 32k he would pay.

    The 'he's being aggressive and trying to bully' is a common line used. CMS is there as a method of enabling child support when the two parents cannot come to an agreement between themselves regarding child support contributions.

    Your friend will have to pay an application fee and then a collection fee.

    A guide figure is 15% of his gross income.

    Your friend would pay £20 application fee to the CMS. Her ex would then be given the chance to direct pay to her but if he fails then the CMS can collect on her behalf. She would pay 4% fee and her ex would pay 20% fee.

    Cant give an estimate as more info needed. Best your friend looks on the CMS calculator.

    She is looking at this document and says (i haven't read it all) that they take into account other things. I think this is an old document not relevant to today's rules.
