Council Tax advice please

Hi
New to this forum.
Was made bankrupt 8/9 months ago due to failed IVA.
I haven't made mortgage payments for nearly a year, and vacated family home around 4 months ago. I am still paying buildings insurance and have been advised by shelter to let process run its course.
From moving out of the house we have stayed with relatives/on caravan park until moving to new rented property in April. We are paying council tax in rented property but are now being chased by old council for outstanding/ongoing council tax liability.
Please can someone provide advice regarding waiving/reducing ongoing mortgaged property council tax liability? Should I be asking mortgage company to repossess?
Thanks in anticipation.

Until the property is repossessed it will be treated simply as an unoccupied property. Once repossessed a Class L council tax exemption can be claimed by you for the property until it is re-occupied or sold.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
Thanks CIS.
Are there any costs/liabilities in terms of CT if it is classed as an "unoccupied property" please?0 -

Hi Serpam
If the council were to seek a Liability Order(s) for the outstanding amounts owed, you could expect costs to be added on - typically between £60-£100. That is before anything that bailiffs might subsequently add on if and when they are passed the debt. At this stage, you should strive to persuade the council to keep the matter "in-house" and keep them abreast of any changes in your financial situation. I take it the council are aware that you are currently an undischarged bankrupt?

Hi Dennis
The council SHOULD be aware as I have advise them previously. Bills were reissued in partner's name only and they have picked up on this "via the system" once registered in new property.
Should there be any reductions in liability? We are still struggling to make ends meet and didn't think we would be liable as have now vacated property.0
