NCI Field agent visit

Hi all, a little advice please :)

I petitioned for my own BR in March this year and after a few letters back and forward most of the unsecured lenders have gone quiet and seem to be leaving me alone. (I knew the OR would be doing it anyway, I just thought I'd try and speed things up)

The Halifax are the ones who keep on sending letters.

Our house, which is in joint names with my wife, has around £80'000 of negative equity and our decision was to let nature take its course with the Halifax and let them repossess.

I ceased making any payments to them in February this year and I'm quite amazed how long it's taken them to actually do anything. I havent contacted them in any way.
They are aware of my BR as the OR has issued his disclaimer stating the house is an onerous property.

We moved out of the house 1st April and have notified the utilities and rates agency. Electric and water have been turned off and final bills paid. I really only visit every now and again to make sure the property is secure and collect post.

Today I have received a letter from NCI with an appointment for a field agent to visit. Now obviously I wont be home when the agent calls, but should I start any corresspondence with the Halifax, like voluntry repossession? or should I just continue to ignore?

I'm in Northern Ireland, if it makes and difference.

  • When I went BR I informed my mortgage company of my plan to surrender possession and that I was going BR. There's no problem as far as I'm aware of keeping them in the loop. I didn't hand back the keys - I just allowed them to take possession, which took them a few months. The important thing is not to sign any documentation that they send you. In a lot of cases they will include some smallprint that says they can still come after you for any shortfall after bankruptcy. You will not disadvantage yourself in any way by not signing anything so that would be my number one piece of advice.

    Hi in my experience they do not get legal until 6 months in arrears,
    My property took 10 months to be returned to the lender.

    Sixth Anniversary
    Perhaps I could email my field agent and the Halifax.. maybe that would speed things up. I dont want it going over the 12 months and end up getting caught for rates again.
