Starting the process

Hi all, hope everyone is well.

I have tried to search the forums but thought i would ask for advise.

I am today starting to complete the forms to go BR.I have 80K hanging over my head. Long story short, debt has caused me alot of pain over the last 6 years. So much at one point i tried to end it all! I lost my home, girlfriend of 12 years. It has taken me 3 years to get my stuff together and luckly i have met someone new and i now need to get all this resolved.

I have some questions i hope you can help with.

First about going to the court, do i have to contact them before hand or turn up with forms and money for the fees?

When completing the forms, do i need to know account numbers? Things have been passed on the debt collectors and then onto others and since i split up from my girlfriend i have not kept all the paper work.

Does the time of how old the debts matter. When i lost my house, i stopped paying all debts, as had planned to file for BR with my girlfriend. After we split i just put my head in the sand and tried to forget everything.

Finally, i am worried that after reading the OR will need bank statements. Last year i received a bonus from work was 2k. I saved some for the fees for BR but as a thank you to my new girlfriend for really helping me during bad times, i paid for a holiday as i thought i may be the last for a while. Will this cause any issues, as really i should have used the money towards paying something off?

    Hi & welcome

    The process is quite easy really. Have you sought advice from one of the free debt places such as Stepchange ? The judge will want to know that you have had the correct advice and know what the implications are. That's the first step.

    You will need to phone the court & make an appointment. Then on the day you take your forms & fees.
    Put on the forms as much as you can remember about your debts. You can explain in the notes that you can't remember all of them. Your credit reference files might show some of them.

    Before this though, make sure you open one or two basic bank accounts. You can go to the Co-op for their cashminder account before you go bankrupt (but don't tell them you are considering BR). Cashminder accounts will be ok to run after you are BR. With Co-op you also get internet access.

    Do your research & read the stickies on this board. If you are clued up about what is going to happen it will make the process much easier for you.

    The OR will want bank statements going back a year (I think it was). Don't worry if you don't have them to hand, send what you have & the OR will get the rest. I can't answer your question about the holiday, but I'm sure someone will be along soon who can.

    Thanks for the advise, i have already set up a CO OP cash minder account. So hopefully will be ok with that account.

    I have used some of the guides just to fill in the Petition, even that was hard but now going to make a start on the SOA.

    I wonder if you could answer a question of the Petition, there is a date it asks for but iam not sure if that should be the date i go or another date? Its the line below,i have wrote here in

    (iii) I have not entered into a voluntary arrangement
    OR
    On (j) HERE I entered into a voluntary arrangement

    (iv) I have not been subject to an administration order under Part VI of the County Courts Act 1984
    OR
    On (j) an administration order was made against me in the
    (l) county court.

    To be honest, when I filled out the forms with all the "cross out what isn't applicable" bits on it, I really wasn't sure what I was doing. I phoned Stepchange, who recommended BR to me & they went through those pages with me & told me what to cross out. Sorry, I can't help with that one!
